Roles & Responsibilities

1. Estate-II Department follows the Notification which stipulates that procedure followed by the L&DO may be followed by NDMC. The Para-3 of the notification states  “The guidelines and procedure followed by Land & Development Office and Directorate of Estates in the matter of substitution / mutation of title, Gift Permission, Sale Permission, Mortgage Permission, Conversion of lease hold into freehold, change of use of premises, regularization / restoration of allotment of shops etc. change of trade, conferment of ownership rights, recovery of misuse / damages charges etc. may also be followed by the local bodies viz. New Delhi Municipal Council and Municipal Corporation of Delhi”. 

2. NDMC  functions as the LESSOR, in respect of shops/Stalls and Flats in these markets and shall exercise all powers performed by Land & Development Office, Directorate of Estates, as the case may be, as the Lessor. As per the Notification, the guidelines and procedure followed by Land & Development Office and Directorate of Estates in the following matters, may be followed by NDMC in respect of the following:-

  1. Substitution/Mutation of title
  2. Gift Permission
  3. Sale Permission
  4. Mortgage Permission
  5. Conversion of Lease-hold into Free-hold
  6. Change of use of Premises
  7. Regularization / restoration of allotment of shops
  8. Change of Trade
  9. Conferment of Ownership Rights
  10. Recovery of Misuse/Damage Charges, etc.

3. The notification further stipulates that in addition to performing the function as lessor/licensor, the local bodies can also take appropriate action against violation of building bye-laws, municipal bye-laws and exercise other statutory powers. 

4. Estate-II Department is abiding the policy and guidelines of L&DO in consultation with Architect & Law Deptt.
